Drafting employment contracts for your business is both difficult and can be dangerous if done incorrectly. An employment contract should include all of the basic, important terms of employment for a specific role. It is legally enforceable and governs the legal relationship between yourself and your employee.
An admin assistant’s contract will include many provisions which are common to all employment contracts such as hours of work, place of work and termination. It may, however, include role-specific clauses which your practice requires. Such a provision may be that you wish to hire your admin assistant as a casual employee.
Hiring a casual employee should not be difficult, but problems can arise if the contract is not formatted correctly. You must make sure that your contract is clear that your relationship will be between yourself and a casual employee.
In a casual contract you will likely need a few things:
- An ‘hours of work’ clause, specifying that hours are not guaranteed.
- A ‘remuneration’ clause, specifying an inclusion of casual loading.
- A ‘casual employment’ clause, specifying that the employee will be casual.
One additional thing you may need is a ‘schedule’ in your contract. A schedule is a list added at the end of a contract and essentially condenses the important information of the contract. The schedule may include a remuneration clause. This will include casual loading, adding another layer of certainty to the casual nature of the contract.
